The North Las Vegas casino where Na'onche Osborne, the adopted son of former Democratic Nevada state senator Pat Spearman, was shot and killed earlier this year is being sued by his family. The Aliante Casino and Hotel is accused of incompetence in its security procedures in the complaint, which was initially reported by KLAS-TV/Las Vegas.
According to prosecutors, 20-year-old Aerion Warmsley killed Osborne, 23, inside Aliante on March 27. Warmsley is currently being charged with murder and auto theft in both state and federal courts.
Osborne's birth mother pursues her own justice as Warmsley awaits his trials, alleging that the casino failed in its obligation to keep its patrons safe.
As the administrator of her son's estate, Willecia Calhoun asserts that Aliante lacked "a sufficient number of guards in visible areas as to deter crime" and did not offer "adequate security for its patrons, invitees, and the public."
In her lawsuit, she claims that the shooting was "reasonably foreseeable" and requests damages in excess of $15,000, which is the typical threshold in civil proceedings in Nevada.
According to grand jury records, Warmsley and another guy had two encounters with a security guard while spending hours in a stolen car close to the casino before to the shooting.
Osborne was later shot and killed inside the building despite those contacts.
The civil suit asks the court to schedule a jury trial. Warmsley's federal trial is set to start in January, and he will have a status hearing in Clark County District Court on December 2.
Aliante's operator, Boyd Gaming, has refrained from commenting on the ongoing legal action.
